Terms of Service

1. Acceptance of Terms

By accessing or using ClubTuned, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this service. In these Terms, “ClubTuned”, “we” and “us” mean LabNow, LLC.

2. Use of Service

You agree to use ClubTuned only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of your account credentials.

Eligibility. You must be at least 13 years old to create a ClubTuned account. We ask for your birth year during signup and do not knowingly allow accounts for anyone under 13. If you believe a child under 13 has created an account, contact support@clubtuned.com and we will remove it.

3. User Content

You retain ownership of content you submit to ClubTuned. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content in connection with the service.

Catalog contributions. Some content — release photos, packaging scans, UPCs, and release details — is submitted specifically so it can be published into the shared collector catalog. When you submit a catalog contribution, the license above includes displaying that content on catalog pages, in search results, in social share previews, and in our editorial tools, with attribution where the feature supports it. Contributions may be edited, corrected, merged with other members' submissions, or declined.

Your responsibility. You may only upload content you created or have permission to use. Do not upload photos taken by someone else, retail or manufacturer marketing images, or anything that infringes another person's rights.

Your privacy controls. What other members can see is governed by your profile and collection visibility settings and your per-photo visibility choices, described in our Privacy Policy.

4. Membership & Billing

Creating an account and tracking your collection is free. Some features require a paid membership, offered on a monthly or annual plan at the price shown at checkout. Memberships auto-renew for the same term until you cancel, and cancelling stops future renewals rather than ending the current term. Prices may change with notice, and any change applies from your next renewal.

Payments are handled by our payment processor; ClubTuned does not store your card details. Refund requests are reviewed case by case — contact support@clubtuned.com.

5. Communications Consent

ClubTuned offers the ClubTuned Alerts SMS/text messaging program. By opting in, you may receive two categories of text messages:

• Transactional notifications: Account alerts such as friend requests, comments, likes, replies, and order updates.
• Promotional messages (requires separate consent): New releases, events, special offers, and community updates.

Opting into SMS is entirely voluntary and is not a condition of purchase or a requirement to use ClubTuned. You may use all features of ClubTuned without providing SMS consent.

Message frequency varies based on your activity and notification preferences. Message and data rates may apply.

To stop receiving messages, reply STOP to any message at any time. You will receive a one-time confirmation of your opt-out. You may also manage your preferences in your account notification settings.

Carriers are not liable for any delayed or undelivered messages.

6. SMS/Text Messaging Terms

The following additional terms apply to the ClubTuned Alerts SMS/text messaging program:

• The ClubTuned Alerts program is compatible with most major US wireless carriers. ClubTuned is not responsible for messages that are undeliverable due to carrier network issues.
• Consent to receive SMS messages is not a condition of purchasing any goods or services, nor is it required to access or use your ClubTuned account.
• Your consent to receive SMS messages is not transferable or assignable to any other person or entity.
• Data obtained from you in connection with the SMS/text messaging program — including your phone number and opt-in consent — will not be sold, rented, or shared with any third parties or affiliates for their own marketing purposes.
• By opting in, you confirm that you are the subscriber or customary user of the mobile device associated with the phone number you provided.

7. Prohibited Conduct

You agree not to:

• Use the service for any illegal purpose
• Harass, abuse, or harm other users
• Impersonate others or provide false information
• Attempt to gain unauthorized access to the service
• Upload malicious code or interfere with the service
• Upload photos or catalog content you do not have the right to use
• Scrape or bulk-copy the catalog, valuations, or member data
• Post sexual, hateful, or violent content, or content involving minors
• Use another member's private collection or contact details outside ClubTuned

8. Moderation, Reporting & Blocking

Members can report comments, community posts, and photos, and can block other members. Blocking is mutual in effect: a blocked member cannot see your profile, collection, photos, listings, or activity, and cannot contact you.

We may hide, remove, or restrict content, and may suspend or terminate an account, when content or conduct breaks these Terms or puts members at risk. Where practical we will tell you why. Serious cases — impersonation, harassment, or content involving minors — may be actioned immediately. You may appeal by contacting support@clubtuned.com.

9. Marketplace & Member-to-Member Transactions

ClubTuned provides a venue where members list items for sale or trade. Except where we are plainly identified as the seller, ClubTuned is not a party to member-to-member transactions. Sellers are responsible for their listings, descriptions, condition accuracy, pricing, shipping, taxes, and compliance with applicable law; buyers are responsible for reviewing a listing before purchasing.

Where a commission applies, the rate in effect at the time of sale is recorded with the order. Disputes between members should first be raised with the other member; contact support@clubtuned.com if that fails. Valuations, price data, and rarity indicators on ClubTuned are estimates for collector reference and are not appraisals, offers, or investment advice.

10. Intellectual Property & Trademarks

ClubTuned's own content, features, and functionality — including the ClubTuned name, logo, catalog structure, and editorial writing — are protected by copyright, trademark, and other intellectual property laws.

ClubTuned is an independent collector platform and is not affiliated with, endorsed by, sponsored by, or authorized by MGA Entertainment. CarTuned and all related names and logos are trademarks of their respective owners and are used here only to identify the products collectors track. Product photography contributed by members is used to document releases in the collector catalog.

11. Disclaimer

ClubTuned is provided "as is" without warranties of any kind. We do not guarantee the accuracy of collection data or availability of the service.

12. Limitation of Liability

ClubTuned shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

13. Changes to Terms

We reserve the right to modify these terms at any time. When we make a material change we will update the "Last updated" date above and, where appropriate, notify members. Continued use of the service after changes constitutes acceptance of the new terms.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. You and LabNow, LLC agree that any dispute arising out of these Terms or your use of ClubTuned will be brought in the state or federal courts located in Illinois, and both of us consent to the jurisdiction of those courts. Nothing here prevents either of us from seeking relief in a small-claims court that has jurisdiction, and this provision does not remove any right you have under the mandatory consumer-protection law of the place you live.

If any part of these Terms is found unenforceable, the rest stays in effect.
